Justin Bieber and Lady Gaga to Sue Bluewater Comics

Bluewater may have landed itself in some incredibly hot water over it’s (infamously bad) biography comics. Kenneth Feinswog has sent cease and desist notices on behalf of his clients, Justin Bieber and Lady Gaga over Bluewater’s unauthorized bio-comics featuring the two musicians. Serious damages and injunctions are being threatened.

If the name Kenneth Feinswog sounds familiar to you, it is because he is the Los Angeles lawyer that unsuccessfully sued Revolutionary comics on behalf on New Kids on the Block and Motley Crue for similar bio-comics.

In the original Revolutionary court case, the judge declared that comics have the same First Amendment rights as any unauthorized book bio. That judgment protected Revolutionary Comics for the remainder of its life, and it can be assumed that Bluewater could look for the same protection. However, Mr. Feinswog is trying to draw the similarities between these comics and things like bootlegged posters and thus there are punishable in a court of law for likeness issues.

The other angle in all of this is the stance that Diamond Comic Distributors will have in all of this. For those that don’t know, Diamond is pretty much the “pimp” of the comic world. If you want to get your book in comic shops, it goes through Diamond to get there, thus they control what is on the market.

Now Diamond is well known to run as far away from risk as possible when it comes to legal pressure. After the Revolutionary case, Diamond refused to distrubute any unofficial biographical comics work . If Diamond were to take this kind of stance with Bluewater, it could be a death sentence for a publisher, that relies on the fame and built in fanbases of the subjects of their bio comics for sales. Without the bio books, Bluewater doesn’t have much to keep them a float.

To add insult to injury for Bluewater, this news comes out days after they have announced that there will be a sequel to the Lady Gaga comic, the first sequel in the bio series.
